2. USERS

The access and/or use of CLINALGIA portal attributes the status of USER and implies user’s acceptance of General Terms and Conditions of Use described herein. The aforementioned Terms and Conditions shall apply independently of the General Contracting Terms and Conditions that may be mandatory.

3. USE OF THE PORTAL

www.clinalgia.com gives access to a wide range of information, services, programmes, and data (hereinafter, “the contents”) on the Internet belonging to CLINALGIA or its licensors to which the USERS may have access. The USER shall assume responsibility for using the portal. This responsibility includes the registration required to access certain services or content.

During this registration, the USER shall be responsible for providing truthful and legitimate information. As a consequence of this registration, the USER shall be provided with a password for which he/she will be responsible, committing him/herself to make a diligent and confidential use of it.

The USER shall commit to make an adequate use of all contents and services (including chat services, discussion forums or news groups) that CLINALGIA, creator of this website, offers through its portal, and, by way of example but not limited to, not to use them for (i) engaging in illicit activities, illegal or contrary to good faith and public order activities; (ii) disseminating racist, xenophobic, pornographic-illegal, apologetic of terrorism or against human rights content or propaganda; (iii) causing damage to the physical and logical systems of CLINALGIA, its suppliers or third parties, introducing or disseminating computer viruses or any other physical or logical systems that may cause the aforementioned damage; (iv) attempting to access and, where appropriate, use the e-mail accounts of other users and modify and manipulate their messages.

CLINALGIA reserves the right to remove all comments and contributions that violate the respect for the dignity of the person, which are discriminatory, xenophobic, racist, pornographic, that violate the youth or childhood, order, or public safety or that, in its opinion, are not suitable for publication.

In any case, CLINALGIA shall not be responsible for the opinions expressed by users through forums, chats, or other participation tools.

4. DATA PROTECTION

CLINALGIA complies with the guidelines of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights, which adapts the Spanish legal system to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of their personal data and on the free movement of such data, which is the current applicable regulation in this area, and other regulations in force at any given time, and ensures the correct use and processing of the user’s personal data.

Furthermore, CLINALGIA informs you that it complies with Law No. 34/2002 of July 11, 2002, on Information Society Services and Electronic Commerce, and shall request your consent to the processing of your email for commercial purposes at all times.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY

CLINALGIA is the owner or assignee of all the intellectual and industrial property rights of its website, as well as of the elements contained therein (including but not limited to images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programmes necessary for its operation, access and use, etc.), owned by CLINALGIA or by its licensors.

According to the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including the making available modality, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorisation of CLINALGIA, are expressly prohibited.

The USER shall be committed to respecting the Intellectual and Industrial Property rights owned by CLINALGIA. The relation between CLINALGIA and the USER shall be bound by current Spanish legislation and any dispute shall be submitted to the Courts and Tribunals of the city of Murcia.
